In 2025, a major regulatory shift will impact all VAT-registered organizations utilizing a POS system, including padel clubs, tennis clubs, and country clubs: the ban on self-certified POS software.

August 2026 Update:
POS compliance: what has changed, and what remains the same.

The requirement to use a compliant POS system has been in effect since January 1st, 2018, and is still fully active. It applies to any VAT-registered business handling transactions with individual customers: all transactional data must be unalterable, secure, stored, and archived.

What changed in February 2026 is the method of proof. Following Article 125 of the 2026 Finance Act, software providers can once again self-certify their own software, whereas only certificates from accredited bodies had been accepted since February 2025.

In practice, the burden of proof remains on you: in the event of an audit, it is up to the club to present the certificate or statement corresponding to the software version currently in use.

Doinsport has chosen the highest standard: certification by an accredited body, issued in France by only two authorized organizations. This means you do not have to rely on a simple self-declaration of honor written by your software provider.

✅ Strengthening the Fight Against VAT Fraud

The 2025 Finance Act aims to enhance financial transparency by imposing strict new requirements on businesses. Starting January 1st, 2025, only POS software certified by an accredited third-party body (such as LNE or AFNOR) will be recognized as compliant.

Until now, many software vendors were allowed to self-certify their compliance with the 2018 anti-fraud law. This practice will no longer be tolerated.

🔍 What Exactly Does the Law Require?

Starting in 2025, any club or facility subject to VAT that uses POS software must prove the compliance of its billing system through:

• a certificate issued by an accredited body (such as LNE or AFNOR),

• or a manufacturer's certificate of conformity, but only if the manufacturer is officially accredited.

The objective is to guarantee that all sales data is unalterable, secure, preserved, and archived.

⚠️ What Are the Risks for Non-Compliant Clubs?

The penalties for non-compliance are severe:

• 💸 A €7,500 fine per non-compliant software or POS system,

• ⏳ A 60-day grace period to achieve compliance,

• 🚨 An additional €7,500 fine if no corrective action is taken.

Even if you run an associative club, a country club, or a padel/tennis club with invoicing exemptions, you are still affected if you use a POS software and are subject to VAT.
