1 – General

The site and the application "Doinsport" are made available by the company DOINSPORT S.A.S, a French company registered with the Marseille Trade and Companies Register under the number 822 078 796, headquartered at 7 rue François Moisson, 13002 MARSEILLE (hereinafter referred to as "DOINSPORT").

These General Terms of Use (hereinafter "GTU") are intended to govern access to and use of the site "Doinsport" (hereinafter the "site") developed by DOINSPORT.

The user refers to any person using the Doinsport site (hereinafter "the User").

By browsing the site, the User agrees to submit unreservedly to these GTU.

2 – Required Configuration

To use the site via a browser, the User must have access to appropriate high-speed Internet and an email address to create their account.

3 – User Account

3.1. Using the site requires the creation of a user account (hereinafter "User Account") on the site.

3.2. Each User is only allowed to have one User Account.

3.3. The User guarantees that the data they provide for the creation of their User Account is true and accurate.

3.4. The User agrees and acknowledges that they are responsible for maintaining the confidentiality and personal nature of the identifiers and passwords associated with their User Account.

Consequently, the User agrees to be the sole and exclusive responsible party towards DOINSPORT for all actions carried out from their User Account and for the protection of their password.

If the User is aware of any unauthorized use of their password and/or User Account, they agree to inform DOINSPORT without delay by email at the following address: contact@doinsport.com

4 – Terms of Use

The services offered on the site are completely free for the user. However, the costs related to the use of the Internet are the responsibility of the user. The User acknowledges that the terms of the contract with their Internet service provider will continue to apply when using the site.

5 – Content Publication

5.1. The term "Content" refers to the information, statements, and content that the User voluntarily disseminates/publishes, either privately or publicly, on the site.

The User is solely responsible for their use of the site, the Content they publish on the site, and any consequences that may arise from it. Under no circumstances shall DOINSPORT be considered responsible for the Content created by the User.

5.2. The User retains their rights to all contents submitted, posted, or published on or through the site. By submitting, posting, or publishing content on or through the site, the user grants DOINSPORT a worldwide, non-exclusive, free license, including the right to sublicense, to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content by any means and on any medium. When it becomes aware of it, DOINSPORT may oppose the publication of any content that does not comply with these GTU.

5.3 During the use of the site, the member agrees:

• To be honest and sincere in their statements.

• Not to publish pornographic content and photos or those that violate modesty and human dignity on the site.

• To respect the privacy of the contents and conversations exchanged with other Members within the Application and to refrain from disseminating or disclosing them.

• Not to violate intellectual property laws.

• Not to violate public order.

• Not to commit defamation and more broadly, not to make insulting statements, particularly those that are racial or discriminatory in nature.

• To respect current laws and regulations.

• Not to incite violence or glorify war crimes or crimes against humanity.

• Not to violate rules of propriety and to remain courteous towards other Members.

• Not to harm, in any way, the normal operation of the Services or the site's infrastructure.

• Not to solicit other Members for the purpose of promoting paid services.

• Not to disclose to other Members their login information, particularly their password for access to their Account.

• Not to advertise or encourage, in any respect, the use of any other service, whether competing or not, and not to commit any unlawful acts related to unfair competition.

6 – Availability

DOINSPORT strives to ensure the availability of the site 24 hours a day, 7 days a week. However, access to the site may be interrupted, particularly for maintenance, upgrades, or emergency repairs, or due to circumstances beyond DOINSPORT's control.

DOINSPORT is committed to taking all reasonable measures to limit these disruptions, as long as they are attributable to it.

7 – Personal Data

7.1. The data collected and subsequently processed by DOINSPORT are those that the User voluntarily transmits during the creation of their User Account.

In accordance with the French Data Protection Act of January 6, 1978 as amended in 2004, the User has the right to access, rectify, and oppose their personal data. They can simply write online at contact@doinsport.com or send a letter to the address at the top of this document, attaching proof of identity.

The information collected from Users is stored securely. The person responsible for collecting and processing this data is the company DOINSPORT, whose contact details are listed above. This data will be used by DOINSPORT for the purpose of using the site and will not be communicated to third parties without the User's prior authorization.

7.2. Personal data relating to the User will be destroyed upon the expiration of legal deadlines or when they are no longer relevant or at the express request of the User.

8 – Intellectual Property

8.1. The site and its content are protected by the Intellectual Property Code as well as by all applicable international standards and are, unless otherwise stated, the exclusive property of DOINSPORT.

Any reproduction, representation, publication, transmission, use, or modification, in whole or in part, of the site and/or any of its elements, made without the prior written authorization of DOINSPORT would constitute an infringement that may lead to civil and/or criminal prosecution.

8.2. DOINSPORT grants the User a revocable, free, non-transferable, and non-exclusive worldwide license to use the site in accordance with the GTU.

9 – Limitation of Liability

The User acknowledges and agrees that the site is provided via the Internet, mobile networks, and therefore, factors outside the reasonable control of DOINSPORT may impact the quality and availability of the site.

By using the site, the User accepts all risks and characteristics inherent in the use of mobile terminals and the Internet, particularly possible technical malfunctions of Internet and mobile telephony networks that may prevent the proper operation and/or functioning of the site, computer bugs, anomalies and/or technical failures, transmission delays, data loss, and the risk of hacking.

Consequently, DOINSPORT shall not be held liable in any case regarding, in particular: the availability, timeliness, security, and quality of all or part of the site, any associated software or application, or any other product, service, or information obtained through the site.

In no case shall DOINSPORT be liable for direct or indirect losses or damages of any kind resulting from the use of the site or any of its elements by the User.

10 – Modifications

DOINSPORT reserves the right to make any modifications that it deems necessary and useful to these GTU at any time.

The functionalities and/or features of the site and the related services are subject to change.

DOINSPORT reserves the right, at any time, to launch new services but also, without notice and at its sole discretion, to remove or modify any or all of the functionalities, features, sections, and/or services of the site.

11 – Termination

11.1. The User may request the termination of the GTU and the deletion of their User Account at any time, without having to justify any reason, by simple email sent to the following address: contact@doinsport.com.

11.2. DOINSPORT may terminate a User's use of the site subject to a one-month notice period. DOINSPORT reserves the right to take all necessary measures, including termination of a User Account, without having to provide reasons, notice, formalities, or compensation to the User in the case of a court decision requiring it, a force majeure event, or breach of these GTU or in the event of suspected fraud. Such termination shall be without prejudice to any damages that may be claimed for damages incurred due to such breaches.

11.3. Upon any termination, the rights and licenses granted to the User will be revoked, and the User must cease all use of the Application. The User will not be entitled to any compensation.

12 – Applicable Law and Dispute

12.1. These GTU are subject to French law.

12.2. In the absence of an amicable settlement, any dispute arising in particular from the formation, interpretation, or execution of the GTU will be submitted to the competent Court of Marseille.

12.3. In the event of translation of the GTU, only the French version is valid and applicable.
